The Scope of the Automatic Stay
The automatic stay can postpone utility disconnections, evictions, and foreclosures. In almost all cases, though, the creditor will be able to continue those proceedings at a later time.
An automatic stay does not help with most tax demands from the IRS, any support payments (child support or alimony), and any criminal proceedings.
Many creditors get around the automatic stay by asking the court to “lift” the stay, and they are often granted. If the court determines that the stay is not serving its intended purpose, then they will allow the creditor to continue in the process.
